Here is a sampling of the contents of the rental agreement we will send to you for your agreement and signature. Of course, the one you receive will have your particular rental information, etc.
THIS IS A VACATION RENTAL AGREEMENT UNDER THE NORTH CAROLINA VACATION RENTAL ACT. THE RIGHTS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND INCLUDE UNIQUE PROVISIONS PERMITTING THE DISBURSEMENT OF RENT PRIOR TO TENANCY AND EXPEDITED EVICTION OF TENANTS. YOUR SIGNATURE ON THIS AGREEMENT, OR PAYMENT OF MONEY OR TAKING POSSESSION OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT, IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION RENTAL.
This Short Term Rental Agreement (the “Agreement”) is made by and between Property Owner and GUEST/TENANT as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:
- The short-term rental begins at 4:00 PM on Check-In Date and ends at 11:00 AM on Check-Out Date.
- We will leave PROPERTY reasonably clean when vacating & will not re-arrange any of the furnishings.
- We will place last remaining dishes in dishwasher and will start the dishwasher prior to departure.
- We will report all broken and/or damaged items to Property Owner immediately.
- No refunds/discounts for late arrival or early departure due to any circumstance including snow, weather, road conditions, car troubles/accidents, acts of God (see Force Majeure below), power or systems failures, airlines, death in my family or accidents/injuries or any other circumstance.
- We will make sure all doors & windows are locked upon check-out.
- We will personally occupy the property for the entire rental period & will not sublet for free or fee any portion of the property.
- We will not unplug or rearrange the TV equipment. We will not move DVD or Blu-ray players from one TV to the other.
- We will not use GLITTER or any other party decorations that leave residue behind.
- We will clean up after ourselves if anyone of our family/friends becomes sick and vomits. We understand bath towels are not appropriate to store eject matter from the stomach. We will clean up after ourselves using paper towels – not bath towels!
- We understand this is NOT A PARTY HOUSE & we will NOT conduct parties. We understand we will be removed from the property by the sheriff’s office.
- We understand QUIET TIME begins at 10:00 PM. We will respect the community when outside by keeping our laughter and voices lower after 10:00 PM.
- We will not have more than 2 vehicles parked at the property. Visitor vehicles are permitted for several hours. All overnight vehicles over specified number must be carpooled. This is a strict policy.
- We understand NO INDOOR SMOKING is permitted. We will only smoke outdoors.
- We understand there are NO PETS allowed & we will not bring our pets or permit visitors pets. If evidence of pets is detected, we will be asked to leave. Any remaining rental amounts will be forfeited.
- We are respectful of all FIRE HAZARDS. We will be responsible & we will prevent forest fires. We will not use candles (except outdoor citronella candles). We will not create a fire pit or campfire on the property or use fireworks. We will not empty grill or fireplace ashes on the property grounds. If we cause a fire on the property grounds or in the home, we will call the fire department & we will notify management immediately.
- We understand it is the responsibility of all our guests & members of our group & those guests we invite to visit to be familiar with all rental policies.

STORM POLICY/ROAD CONDITIONS: No refunds will be given for storms, rain, ice or snow. Mountain roads can be curvy & steep. Our roads are well maintained; however, we do not refund due to road conditions of any type. You are encouraged to buy travel insurance to cover emergencies resulting in delays or cancellation, including weather & road conditions. I agree that owner/management will not be responsible or liable to me or any other party for interruptions or irregularities in your electric service.
FORCE MAJEURE: Neither owner nor manger shall be liable for events beyond their control which may interfere with your occupancy of the property such as any weather event, an event or effect that cannot be reasonably anticipated or controlled, or acts of governmental agencies, fires, strikes, war, terrorists strikes. No refunds shall be given for such occurrences & you are encouraged to obtain travel insurance to cover such risks.
MECHANICAL FAILURE AND REPAIRS: Management does routine inspections of the property to ensure all appliances & amenities are functioning properly. In the event of mechanical failures such as, but not limited to, Hot Tub, AC/Heat, Well Pump, or any other appliance that fails to operate properly during your stay, owner/management will not be held responsible. These failures are beyond our control & no refund or rent reduction will be given. Please report inoperative equipment to management & every effort will be made to have repairs done as quickly as possible during reasonable hours. Renters understand & agree that the owner or host reserves the right to enter the cabin at any time with prior notice for the purpose of making needed repairs. You are encouraged to buy travel insurance to cover emergencies resulting uninhabitable conditions due to mechanical failures.
WELL & SEPTIC SYSTEMS: The property is on well and septic systems. Well water is clear and very good. The septic system is very effective, yet will clog up if improper material is flushed or placed in sink drains. Do not flush anything other than toilet paper. No feminine products should ever be flushed at any time. We do not have garbage disposals, therefore, please dispose of leftover food in the trash.
WAIVER OF LIABILITY: You understand use of hot tub is at your own risk and that special risks may be involved in using the hot tub, as well as using other areas of the property. You accept full responsibility for any skin condition or any other illness arising from use of the hot tub & hold management harmless. You understand there are potential dangers that the hot tub may present to children who are not carefully supervised as well as the danger to any person using the hot tub, or if a person has health risks or if a person uses the hot tub while intoxicated or using any kind of drugs or medication, or uses the hot tub if pregnant. You understand the risks discussed above & agree that you will assume all responsibility for yourself & your guest for the consequences of those risks. You agree to waive any claim whatsoever against owner or manager for accidents or claims arising from your guests’ use of hot tub. You will notify management of any damages that occur to the hot tub & its support equipment through you or your guests’ misuse and/or negligence, for example, but not limited to standing/walking on the hot tub cover or damaging vinyl, or allowing the water level to become too low (below first level of jets). Infants are not permitted in hot tub.
DISCLAIMER. Tenant & Tenant’s Guests agree to release & indemnify the owner, manager & property from & against all liability, should anyone be injured upon the premises during the term of the rental, resulting from any cause whatsoever, except in the case of personal injury caused by the negligent act of the owner or manager. And further that the owner or manager is not responsible for any loss or damage to tenants’ /guests’/invitees’ property caused directly or indirectly from foul, inclement weather conditions, acts of nature, failure of heat, accidents related to fire, heaters, stoves, tenants’/guests’/invitees’ failure to remove snow around access areas, or any unforeseeable circumstances. Under no circumstances will tenants or their guests/invitees hold the owner or manager of the property responsible for any damages or claims of any kind resulting from their stay including the use of the hot tub, except for intentional acts of harm or negligence.
I confirm I have read, understand, agree to, & will abide by this rental agreement/waiver/disclaimer & all conditions stated herein. By accepting this reservation, it is agreed that all guests of the registered renter are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premises. By signing below, I agree to the conditions on all pages of this rental agreement. I acknowledge I have read and agree to the cancellation policy. I understand changes to this agreement are not acceptable by management/owner. I understand my rights to purchase vacation travel insurance to cover any conditions that may arise to delay my arrival or prevent any portion of my stay at the property.
